Tobacco-Free Schools Information- ENGLISH

The Orcutt Union School District prohibits the use of tobacco products at any time in District-owned or leased buildings, on District property, and in District Vehicles. (Health and Safety Code 104420; Labor Code 6404.5; 20 USC 6083)

This prohibition applies to all employees, students and visitors at any instructional program, activity, or athletic event.

Smoking or use of any tobacco-related products and disposal of any tobacco-related waste are prohibited within 25 feet of any playground. (Health and Safety Code 104495)

Any employee or student that violates the district's tobacco-free school policy shall be asked to refrain from smoking and shall be subject to disciplinary action as appropriate.

Any other person who violates the district's policy on tobacco-free schools shall be informed of the district's policy and asked to refrain from smoking. If the person fails to comply with the request, the Superintendent or designee may:

  1. Direct the person to leave school property
  2. Request local law enforcement assistance in removing the person from school premises
  3. If the person repeatedly violates the tobacco-free schools policy, prohibit him/her from entering district property for a specified period of time

"The use of products containing tobacco and/or nicotine, including, but not limited to, smokeless tobacco, snuff, chew, clove cigarettes, electronic hookas, and other vapor emitting devises, with or without nicotine content, that mimic the use of tobacco products any time, in charter school or school district-owned or leased building, on school or district property and in school or district vehicles is prohibited. However, this section does not prohibit the use of possession of prescription products, or other cessation aides such as nicotine patches or nicotine gym. Student use or possession of such products must conform to the laws governing student use and possession of medication on school property."
